The petitioner is an accused in S.T. Case No. 99 of 2025, arising out of Jarmundi P.S. Case No. 44/2025. It has been alleged that the petitioner had committed rape upon the informant and by showing her obscene photos he had continued to commit such act. It has been submitted by the learned counsel for the petitioner that the date of occurrence is from September, 2024 to 03.11.2024 but the First Information Report has been lodged on 02.04.2025 and no explanation has been submitted with respect to such inordinate delay. It has further been submitted that looking to the First Information Report a threatening was given by the petitioner to the informant and her husband which would indicate that her husband was aware of the incident but even then, no First Information Report was lodged by them. Learned counsel adds that the petitioner is in custody since 18.04.2025. Learned A.P.P. has opposed the prayer for bail of the petitioner. On consideration of the inordinate delay in institution of the First Information Report despite the husband of the informant being aware of such act as Neutral Citation No. ( 2026:JHHC:5699 ) alleged, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Addl.
