The present criminal miscellaneous bail application has been preferred by the accused-petitioner under Section 482 of the BNSS, 2023, apprehending his arrest in connection with FIR No. 233/2022, Police Station Deeg, District Deeg, for the offences punishable under Sections 323, 341, 384, 327 of the IPC.

Learned counsel for the petitioner submits that, in compliance of order dated 17.07.2026, petitioner has already joined the investigation and has been interrogated by the Investigation Officer.

Learned counsel for the petitioner submits that although the petitioner was not named in the F.I.R., and subsequently his name has been taken by the victim statement recorded under Section
[2026:RJ-JP:28857] (2 of 3) [CRLMB-7988/2026] 181 of the BNSS 2023. It is contended that the petitioner has been falsely implicated in the F.I. R.

Learned counsel for the petitioner further submits that, as per the allegation in the F.I.R. only three persons were found involved and who have already been enlarged on bail. He further submits that the injuries are simple in nature, therefore, the petitioner may be enlarged on anticipatory bail. 5. Learned Public Prosecutor vehemently opposes the bail application. 6. The Investigation Officer is present before this Court. He submits that petitioner has already participated in the investigation and has been interrogated by him. 7. Heard learned counsel for the petitioner, learned Public Prosecutor and perused the material available on record. 8. Without expressing any opinion on the merits of the case and upon consideration of the submissions advanced, and particularly the fact all the offences are triable by Magistrate; that the three co-accused as per F.I.R. have already been enlarged on bail, that the petitioner has already participated in the investigation and has been interrogated by the Investigation Officer and no custodial interrogation of the petitioner is required, this Court is of the opinion that the bail application deserves to be accepted. 9. Accordingly, the present anticipatory bail application filed by the accused-petitioner under Section 482 of BNSS, 2023, is allowed. It is directed that, in the event of the arrest of the accused-petitioner, Anil Kumar S/o Ashok Kumar, in connection with FIR No. 233/2022, Police Station Deeg, District Deeg, he shall be released on bail, provided he furnishes a personal bond in the
[2026:RJ-JP:28857] (3 of 3) [CRLMB-7988/2026] sum of Rs. 1,00,000/- (Rupees One Lakh only) along with two sound and solvent sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand only) each, to the satisfaction of the concerned Investigating Officer/Station House Officer, subject to the following conditions: (i) The accused-petitioner shall make himself available for interrogation by the Investigating Officer as and when required and shall cooperate with the investigation; (ii) The accused-petitioner shall not, directly or indirectly, make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such person from disclosing those facts to the Court or to any Police Officer; (iii) The accused-petitioner shall not leave India without the prior permission of the concerned Court; and (iv) The accused-petitioner is further directed not to take undue advantage of the liberty granted to him or misuse the same.
It is made clear that any observations made by this Court in the present bail application are only for the purpose of deciding the instant application and shall not influence or affect the merits of the case during the course of trial. (BIPIN GUPTA),J 103/KRATIKA
