Case No. 144 of 2025, registered for the offence under Section 303(2), 317(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Hazaribag. 2. Learned counsel appearing for the petitioner submits that the name of the petitioner has come on the basis of confessional statement and further the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-6 of the petition. He next submits that only the mobile phone has been recovered from the possession of this petitioner, wherein the allegation is there of taking away Rs. 2 lakhs and inverter and battery. He then submits that the petitioner is in judicial custody since 27.08.2025. 3. Learned A.P.P. appearing for the State has opposed the prayer and submits that the name of the petitioner has come on the basis of confessional statement. 4. Considering that the name of the petitioner has come on the basis of confessional statement and the mobile phone, recovered from [2026:JHHC:1168] -2- the possession of this petitioner, was not the article, which is the genesis of filing the FIR and further the petitioner is in judicial custody since 27.08.2025, I am inclined to release the petitioner, on regular bail. 5. Accordingly, the petitioner, named above, is directed to be released on regular bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribag, in connection with Hazaribag Muffasil P.S.
