The applicant has preferred this First Bail Application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail, as they have been arrested in connection with Crime No.437/2025, registered at Police Station- Sarangarh, District - Sarangarh - Bilaigarh (C.G.) for the offence punishable under Sections 20(b) and 29 of Narcotic Drugs and Psychotropic Substances Act. (for short ‘NDPS’). 2. The prosecution story, in brief, is that on 28.08.2025, during a vehicle- checking operation, the Station House Officer of Sarangarh attempted to stop a black four-wheeler and a container vehicle. Both vehicles were subsequently stopped near MRM Rice Mill on Nandeli Bypass Road. Shyam Babu Choudhary, Ranjit Sahu, Narayan Prasad Sahu, and Mrs. Sanjana Sahu were travelling in the black Mahindra four-wheeler bearing PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.02.04 15:10:39 +0530 2 registration number OD-02-AE-1444, while Devendra Sharma was driving the container vehicle bearing registration number HR-46-E-2249. Upon checking the container vehicle, 29 packets of the narcotic substance marijuana were recovered, which, on weighing, totaled 91 kg 320 grams. 3. Learned counsel for the applicant has argued that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that the applicant was travelling in the black Mahindra four-wheeler bearing registration number OD-02-1444, and no contraband substance was recovered from the vehicle in which the applicant was present. It is also submitted that the charge-sheet has already been filed and that the applicant has been in judicial custody since 28.08.2025. The applicant has no criminal antecedents. As the conclusion of the trial is likely to take considerable time, learned counsel prays for grant of bail to the applicant. 4. On the other hand, the learned counsel for the State opposes the bail application and submits that the charge-sheet has been filed. He further submits 29 packets of the narcotic substance ganja were found, which, upon weighing, were found to total 91 kilograms and 320 grams, which is much more than the commercial quantity, which is much more than the commercial quantity. The allegation against the applicant is that he was piloting the said container vehicle. Hence, his bail application is liable to be dismissed. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the fact that as per the facts available in the 3 case, on 28.08.2025, during a vehicle-checking operation conducted by the Station House Officer of Sarangarh, a black four-wheeler and a container vehicle failed to stop when signaled and were subsequently stopped near MRM Rice Mill on Nandeli Bypass Road, in the black Mahindra four-wheeler bearing registration number OD-02-AE-1444, Shyam Babu Choudhary, Ranjit Sahu, Narayan Prasad Sahu, and Mrs. Sanjana Sahu were seated, while Devendra Sharma was the driver of the container vehicle bearing registration number HR-46-E-2249. Upon checking the container vehicle, 29 packets of the narcotic substance ganja were found, which, upon weighing, were found to total 91 kilograms and 320 grams, which is much more than the commercial quantity. The allegation against the applicant is that he was piloting the said container vehicle, and the applicant has failed to give any explanation for the same and it cannot be said to be a case of false implication, accordingly, the bail application of applicant – Narayan Prasad Sahu involved in Crime No.437/2025, registered at Police Station- Sarangarh, District - Sarangarh - Bilaigarh (C.G.) for the offence punishable under Sections 20(b) and 29 of Narcotic Drugs and Psychotropic Substances Act. (for short ‘NDPS’), is rejected at this stage. 7. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 8.
