For the Informant : Mr. Arwind Kumar, Advocate ------ Order No.02 Dated : 05.01.2026 Bail petition filed by the petitioner- Sagir Ansari, who is in custody since 21.08.2025 in connection with Nimiyaghat P.S. Case No. 76 of 2025 for the offence registered under Sections 69 of the BNS pending in the Court of learned Judicial Magistrate, First Class, Giridih, is pressed into motion. As per the FIR, the petitioner on false promise of marriage had established physical relationship with the victim girl for last six months. It is submitted by the learned counsel on behalf of petitioner that there has been inordinate delay in lodging of the FIR by one month and seven days since last date of incidence. The victim girl is aged 20 years, whereas the petitioner is 23 years old. There is no material to show that any inducement was offered or there was deception. Learned A.P.P. does not oppose the prayer for bail however, learned counsel appearing on behalf of the informant has vehemently opposed the prayer for bail. It is submitted that the delay as such is inconsequential and the offence is directly attracted to the facts and circumstance of the present case. On false pretext of marriage, the victim girl had been sexually assaulted by this petitioner. From the FIR, it is apparent that it is case of consensual physical relationship between two consenting adults. Further, allegation was that for more than six months physical relationship continued. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
