(At Present Confined In District Jail Jhalawar). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Ajay Singh Yaduvanshi For Respondent(s) : Mr. Jaiprakash Tiwari, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR
Order 22/07/2026
1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.21/2026 registered at Police Station Jhalawar Sadar, District Jhalawar for offences under Section 103(1), 109(1) and 3(5) of BNS, 2023.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioner contends that the petitioner has falsely been implicated in this case. He submits that there is no allegation in the FIR connecting the present petitioner with the death of the deceased- Roopsingh. The FIR has been lodged against the co-accused Dulhe Singh, Jugraj, Jagdish, and Raghoo Singh, who have been specifically named therein with the allegation that they caused the death of deceased Roopsingh by using a firearm. It is further submitted that the sole allegation
[2026:RJ-JP:28260] (2 of 3) [CRLMB-11364/2026] against the present petitioner is that the firearm used in the alleged incident was sold by him to co-accused Nahar Singh, from whom the said firearm was allegedly obtained and used by co- accused Jagdish in the incident. No other substantial allegation has emerged against the present petitioner except that the firearm used in the incident was allegedly sold by him to co- accused Nahar Singh. Learned counsel further submits that the charge-sheet has been filed in the matter, wherein only charge under Sections 5/25 of the Arms Act has been levelled against the present petitioner. Petitioner is in custody since 07.04.2026 though 21 cases have been reported against him, however, three of the said cases have already been decided, and in the remaining cases, he is already on bail. It is further submitted that mere pendency of criminal cases against the petitioner, in the absence of any specific allegation connecting him with the alleged offence of murder in the present matter, cannot be a ground to deny him the benefit of bail. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, consequently, the bail application deserves to be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application filed by the petitioner. However, she has not been able to controvert the fact that the only allegation against the petitioner is that the firearm used in the present case was allegedly sold by him to co-accused Nahar Singh, which was thereafter used by co-accused Jagdish in the alleged incident. [2026:RJ-JP:28260] (3 of 3) [CRLMB-11364/2026]
5. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Bhopalia S/o Heeralal, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
