JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is accused No.3, who gets embroiled in a crime for the offences punishable under Sections 341, 364A, 397, 120B, 506 of IPC. 2. It transpires that qua the other accused, the complainant has settled the dispute with them. The Co- ordinate Bench of this Court has quashed the proceedings qua the accused Nos.1, 4 and 9 in terms of the order dated 21.03.2025 passed in Crl.P.No.4023/2025. The aforesaid order reads as follows:- "The petitioners-accused, who are facing trial for offences punishable under Sections 341, 364A, 397, 506 and 120B of the IPC, are before this Court seeking relief. 2. The prosecution alleges that the petitioners- accused wrongfully restrained the complainant, abducted - 3 - HC-KAR NC: 2026:KHC:11562 CRL.P No. 2386 of 2026 him, demanded a ransom of Rs.2.5 lakh, and threatened him with dire consequences. 3. The parties are present before this Court and have filed an application for compounding, stating that initially, a First Information Report (FIR) was registered against unknown persons. During the course of the investigation, the petitioners-accused were apprehended and implicated as accused. The complainant, who is present before this Court, has admitted that the petitioners neither abducted him on the date of the incident nor demanded any ransom for his release, therefore, the impugned proceedings may be quashed. 4. The application is placed on record. 5. Although the alleged offences are cognizable and non-compoundable, considering that the parties have amicably resolved the dispute among themselves, subjecting the petitioners to trial would be futile. Given the settlement reached between the parties, the likelihood of conviction is remote and bleak. Therefore, the continuation of criminal proceedings would amount to an abuse of the process of law. 6. Accordingly, the petition is allowed. 7. The impugned proceedings in C.C.No.8630/2023, pending on the file of the II Additional Chief Judicial Magistrate, Bengaluru Rural, insofar it relates to the petitioners herein is quashed." - 4 - HC-KAR NC: 2026:KHC:11562 CRL.P No. 2386 of 2026 3. Only the accused No.3 had remained in the fray of accused to get the proceedings closed on a compromise. The petitioner being accused No.3 has again entered into a settlement with the complainant. 4. In the light of the earlier settlements being accepted and the proceedings being closed, notwithstanding the fact that the offence punishable is one under Sections 341, 364A, 397, 120B, 506 of IPC, I deem it appropriate to accept the settlement like the acceptance of settlement qua other accused and close the proceedings against petitioner/accused No.3 as well. 5. For the aforesaid reasons, the petition stands disposed. The proceedings in C.C.No.8630/2023 pending on the file of the II Additional Chief Judicial Magistrate, Bengaluru Rural, Bengaluru, are quashed qua the petitioner/accused No.3.
