The present writ petition is filed seeking to declare the action of the 3RD Respondent in continuing the petitioner under suspension beyond stipulated period of one year prescribed in G.O.Ms.No.22 General Administration (SER-C) Department dated 29.02.2024 without being any valid reason is illegal, arbitrary. 2. Heard the learned counsel for the petitioners and the learned Government Pleader for the respondents. 3. The case of the petitioner is that he was appointed as Lab Technician Grade-II vide proceedings Rc.No.1980/G3/2008 dated 06.08.2008 issued by the District Medical & Health Officer, Srikakulam, and joined duty at Ganguvada, Pathapatnam. Subsequently, the 3rd respondent placed him under suspension vide proceedings Rc.No.609/E3/2024 dated 30.11.2024 without specifying the period of suspension, without indicating any pending enquiry, and without issuing articles of charge. On the same day, the Anti-Corruption Bureau, Srikakulam Range registered a case in Cr.No.03/RCA-ACB/SKL/2024 alleging possession of assets disproportionate to known sources of income under Section 13(2) read with Section 13(1)(b) of the Prevention of Corruption Act, 1988 (as amended in 2018). It is submitted that as per G.O.Ms.No.22 dated 29.02.2024, the suspension order has to be reviewed every four months; however, no such review has been conducted and the petitioner has been continued under suspension for about one year and four months without initiation of any departmental enquiry. The petitioner submitted representations dated 12.01.2026 to the 3rd respondent and 23.01.2026 to the 2nd respondent seeking reinstatement. The 2nd respondent, vide proceedings dated 06.02.2026, directed the 3rd respondent to take necessary action and submit a compliance report within seven days, but the same has not been complied with. Hence, the writ petition. 4. The learned Government Pleader for the respondents submitted that, in terms of G.O.Ms.No.22 dated 29.02.2024, the respondents would review the suspension of the petitioner and pass appropriate orders on the representations of the petitioner in accordance with law. 5. Considering the submissions made and upon perusal of the material placed on record, this Court deems it appropriate to direct the respondents to consider the representations dated 12.01.2026 and 23.01.2026 submitted by the petitioner seeking review of his suspension in accordance with G.O.Ms.No.22 dated 29.02.2024, and to pass appropriate orders thereon within a period of one (01) month from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. There shall no order as to cots.
