By way of present application, the applicant is seeking direction to transfer the amount of Rs.3 crores deposited by the applicant before the Trial Court pursuant to the order dated 13.12.2019 to the Navodaya Urban Co-operative Bank Limited, Nagpur. 3. Learned Counsel for the applicant invited my attention to the order passed by this Court on 13.12.2019 particularly on clause nos.(ii), (vi) and (vii), which read as under : “(ii) The applicants are directed to deposit ₹1,00,00,000/- ( ₹ One Crore Only) within a period of seven days from today in the Court of 11th Additional Sessions Judge, Nagpur, which is also a Special Court under the MPID Act in Special Criminal Case No.8/2019. … (vi) Within a period of sixteen weeks from today, the applicants are directed to deposit ₹2,00,00,000/- (Two Crore Only) in the Court of learned Additional Sessions Judge, Nagpur (Special Court under the MPID Act). 2026:BHC-NAG:12537 2 23.appp.3130.2026 (vii) Learned Additional Sessions Judge, Nagpur (Special Court under the MPID Act), is directed to see that 2,00,00,000/- ( Two ₹ ₹ Crore Only) are deposited with the said Court within sixteen weeks from today. And if there is any default by the applicants, the bail granted by this Court shall be treated as cancelled and it shall be open for the said Court to issue non bailable warrant against the applicants.” 4. Although he submits that in compliance of the said order, the applicant has deposited the amount of Rs.3 crores with the Special Court, however, he wanted to settled the accounts with the said Bank under OTS scheme, and therefore, he prayed to transfer the said amount to the Navodaya Urban Co-operative Bank Limited. 5. Upon considering the submissions, it is needless to mentioned that this Court vide order dated 13.12.2019 has granted bail to the applicant only on the aforestated conditions and accordingly, the applicant has deposited Rs.3 crores as directed by this Court. While passing the order the further conditions were also put in by this Court i.e. condition no. (v) and (viii), which read as under : “(v) If the amount is not deposited within seven days from today, it shall be treated that no bail is granted to the applicants. ... (viii) If the amount, as directed, is deposited, it shall be open for said Court to deal with said amount, in accordance with provisions of the Maharashtra Protection Of Interest of Depositors (In Financial Establishments) Act.” 3 23.appp.3130.2026 6. In view of the above circumstances, in my opinion, the application cannot be entertained since the very purpose of depositing the amount as was directed by this Court, would be frustrated. 7.
