Mr. Aditya Kaushal, Advocate, for respondents No. 1 & 2. None for respondent No.3 The instant application has been filed for condonation of delay in filing the present appeal. It has been averred in the application that impugned judgment and decree was passed by the learned District Judge, Kangra, at Dharamshala, on 02.08.2025 by affirming the judgment and decree as passed by the learned trial Court. It has been averred that though the learned counsel representing the applicant/appellant, after the aforesaid decision of the case is, said to have informed the applicant/appellant in the last week of August, 2025, through ordinary post, however, the same was never received by the present applicant/appellant and thus remained unaware of the decision of the appeal. It has been further averred in the application that it is only in the second week of November, 2025, when the counsel representing the applicant informed the applicant/appellant about the decision of the case through his relative, who visited the Court at Dharamshala, for the purpose of attending his own case. Thereafter the applicant/appellant contacted his counsel at Dharamshala and came to know about the decision of the case and he was advised to assail the said judgment before this Court. Thereafter after bringing the entire case file, learned counsel was engaged for the institution of the present appeal. In this process, delay of 30 days has occurred, which is neither intentional nor willful but the same has occurred due to unavoidable circumstances, which were beyond the control of the applicant/appellant. Keeping in view the averments as made in the application, which is duly supported by an affidavit and keeping in view of the fact that the learned counsel appearing for the respondents No. 1 and 2 has no objection in case the delay is condoned, the present application is allowed the aforesaid delay in filing the present appeal is condoned.
