Criminal appeal is against conviction whereby the learned Additional Sessions Judge and Special Court at Chandrapur by virtue of impugned judgment dated 01.03.2023 passed in Special Atrocity Case No.2/2019 has convicted the present appellant for the offences punishable under Sections 302, 449, 436 and 201 of the Indian Penal Code. 3. Learned counsel for the applicant/appellant submits that the appellant who is originally from Uttar 2026:BHC-NAG:12654-DB 2 101 Appa no.743.26.odt..odt Pradesh belongs to a poor family and his family members are illiterate therefore, when the appellant was convicted, his family members were not aware as to what next steps were to be taken. However, after realizing that the present appeal needs to be filed, the family members of the appellant arranged money for filing the same and contacted the advocate, as such there is a delay of 693 days in filing present appeal. Learned counsel for the applicant submits that delay caused in filing present appeal is bonafide and unintentional and hence, deserves to be condoned by this Court. 4. We are of the considered opinion that the delay if not condoned will deprive the present appellant of his right of appeal against conviction. We are of the considered opinion that the appellant has made out a sufficient cause in condoning the aforesaid delay and accordingly, allowed present criminal application. Delay 693 days caused in filing present appeal is condoned. 5. Criminal Application is disposed of. CRIMINAL APPEAL ST. NO.10271 OF 2026 6.
