Petitioner has filed this writ petition, seeking following reliefs:- “10.1 That, this Hon’ble court may kindly be pleased to direct the respondent no. 2 to consider case of the petitioner for posting, where post is vacant i.e. Govt. Learned counsel for the petitioner submits that petitioner while working on the post of lecturer LB (History) and posted at Govt. High School Daspur, Block- Kanker, District- North Baster, Kanker (C.G.) is transferred to Govt. High School Dubey Umargaron, Block & District- Baster (C.G.) under rationalizations policy, treating him to be in excess in that school. Aggrieved with the transfer of his posting petitioner has filed a writ petition bearing WPS No. 5205 of 2025 which was disposed of permitting the petitioner to submit a representation before the committee and till decision on representation is communicated to the petitioner, order of transfer of petitioner was kept in abeyance. Petitioner submitted representation which was dismissed vide order date 24.10.2025, he thereafter have approached the transferred place of posting for his joining, however his joining was not accepted by the Principal Govt. High School Dubey Umargaron, Block and District Baster (C.G.) on the ground that there is only one post of history (social science) and it is filled up by promotion and some other person is occupying that post. Since then petitioner is not working anywhere. 3. Learned counsel for State submits that from the documents enclosed along with this writ petition, it is appearing that earlier at the time of order of transfer issued in favor of petitioner the post was vacant, however, when petitioner did not joined pursuant to the order of High Court the said post was filled up subsequently by deputing an 3 / 3 employee on promotion. Petitioner can submit an appropriate representation before respondent no. 2, and appropriate orders will be passed considering the claim of petitioner. 4. I have heard learned counsel for the respective parties. 5. On due consideration of submission made by learned counsel for the respective parties and further the decision for posting is to be taken by respondent no. 2, instead of keeping this writ petition pending and seeking reply from respondents, I find it appropriate to dispose of this writ petition at this stage permitting petitioner to submit fresh representation before respondent no. 2 after apprising him all the relevant facts of the case within a period of one week and if such a representation is submitted concerned authority shall take decision on the representation to be submitted by petitioner within an outer limit of two weeks thereafter, and to pass appropriate orders for posting of petitioner. 6.
