The petitioner is apprehending his arrest in connection with Bashistanagar P.S. Case No.04/2023 registered under Section 27(a)/28/29/30 of the Narcotic Drugs and Psychotropic Substance Act, pending in the Court of Learned Principal District & Session Judge, Chatra. 3. Learned counsel appearing for the petitioner submits that the false allegation is made against the petitioner of cultivation of poppy plant on the forest land. He also submits that even the land is not belonging to the petitioner and the petitioner has got no criminal antecedents as disclosed in para 12 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of cultivation of poppy plants on the forest land. 5. Considering that the land is of the Forest Department and that is not belonging to the petitioner and the petitioner has got no criminal antecedents as disclosed in para 12 of the petition, In view thereof, 2026:JHHC:2725 2 the petitioner above named is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and condition or sureties, the learned Court may deem fit and proper.
