Learned Counsel for the applicants submits that present application has been necessitated by the fact that the respondents are not honouring the judgment passed by this Court on the ground that whereas the name of the applicant, i.e. petitioner No.3, is mentioned in the memo of parties Lucky Suryavanshi, in terms of the record, his name is only Lucky. This Court is of the considered view that if the Authorities are not implementing the judgment on this short count, then the same amounts to overreaching the judgment passed by the Court. In case, the other particulars which are given in the Memo of Parties of petitioner No.3 are correct and if there is no confusion that beside the present petitioner there is no other incumbent of same particulars in the respondent-Department, dehors the fact, as to whether the name of the petitioner is mentioned in the Memo of Parties as Lucky Suryavanshi or Lucky, the judgment has to be implemented. In fact, it appears that hyper-technical attitude is being adopted by the Authorities for not implementing the judgment of the Court. Accordingly, this application is disposed of with the direction that the Authorities shall implement the judgment passed by this Court by construing the name of petitioner No.3 as Lucky instead of Lucky Suryavanshi.
