4. Perused the FIRs as at Annexure-1. Referring to the bail orders at Flags-A to D, it is submitted to the Court by learned
counsel for the petitioners that both the accused persons are owners of the vehicles involved in the alleged transportation of sand having no other similar antecedents and therefore, they should be granted pre-arrest bail. Mr. Panda, learned counsel for the State opposed plea of the petitioners and release on bail on any such ground as has been advanced. Gone through the FIRs at Annexure-1 and it reveal that the alleged vehicles have been used for illegal transportation of sand. It is informed to the Court that the vehicles in question have been released in the meantime. Considering the above facts and submission of
learned counsel for the petitioners that none is having any past antecedent of similar nature but likely to be involved being the owners of the alleged vehicles and hence, apprehend arrest, this Court, recording the objection of Mr. Panda, learned counsel for the State, is of the view that it is not a case of pre-arrest bail instead both should be directed to surrender before the learned court below for being released on bail with stringent conditions imposed.
