Kausik (Allowed) CRM (NDPS) 147 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with NCB Crime No. 01/NCB/KOL/2023 dated 3rd January, 2023 under Section 8(c) and 20 (b) (ii) (c) and 29 of the NDPS Act, 1985. And In the matter of : Jarina Bibi ……Petitioner. Mr. Tapas Kr. Ghosh Mr. Tanmoy Chowdhury ……for the Petitioner. Mr. Gouranga Das Mr. Somnath Adhikary ……for the Union of India. Learned advocate appearing for the petitioner submits that petitioner was taken into custody for violation of condition of the order passed in CRM (NDPS) 1423 of 2024 and is detained since 20th August, 2025. Learned advocate for the NCB submits that all the witnesses have been examined and only one witness is left. It has been acknowledged by both the parties that rest of the accused persons in this case are on bail. Having considered the totality of the circumstances, period of detention of the petitioner and that other accused 2 persons are on bail I am of the view that the petitioner be released on bail. Petitioner, namely, Jarina Bibi shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge (under NDPS Act) – cum – Learned Additional Sessions Judge, Hooghly. If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of Pandua Police Station except for the purposes of attending the Court. Accordingly, CRM (NDPS) 147 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
