Sekhar Reddy, learned counsel for the petitioner; Sri P. Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj and Rural Development, for respondents 1 to 4. 2. Petitioners, four in number, filed the above writ petition complaining that respondents 3 and 4 are attempting to lay a road in their lands admeasuring Ac.1-00 cents, Ac.1-00 cents, Ac.1-80 cents and Ac.1-00 cents respectively in survey No.145-4, Kodihalli Village, Lepakshi Mandal, Sri Sathya Sai District without following due procedure as illegal and arbitrary. 3. Learned counsel for the petitioners would submit that petitioners 1 to 3 purchased the aforementioned lands under registered sale deed Nos.4836 of 2025 dated 19.05.2025, 1065 of 2007 dated 07.02.2007 and 5294 of 2010 dated 19.08.2010 respectively and petitioner No.4 derived title from his father, who in turn, purchased the same under a registered sale deed No.279 of 1999 dated 29.01.1999. The petitioners’ names were updated in the Record of Rights (ROR). Learned counsel would further submit that respondents 3 and 4 are attempting to lay a road in the aforementioned lands, without following due process of law. 4. Learned Assistant Government Pleader for Panchayat Raj and Rural Development produced the instructions furnished by respondent No.3 vide Rc.No.14/2026/SA dated 08.04.2026 and submitted that the respondent authorities will follow due procedure. 5. In para No.3 of the instructions, it is stated as follows: <In the reference 2nd cited, the Mandal Engineering Officer, MPP., Lepakshi has submitted that, the Petitioner raised objection not to execute through their land for a length of 150 mts along the road. Hence the work has been stopped till further clearance.= 6. Given the instructions of respondent No.3, inviting the counter and keeping the writ petition pending will not serve any purpose. Hence, this writ petition is disposed of at the admission stage with the consent of learned counsel on either side, directing respondents 3 and 4 not to interfere with the petitioners’ possession of the aforementioned lands, without following due process of law. No costs. This order will not preclude the respondent authorities from conducting a survey, if any, by following the procedure.
