2026:HHC:20390 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA. LPA No. 156 of 2026 Date of decision: 26.05.2026 State of H.P. & Ors. …Appellants Versus Mohit & Ors. …Respondents Coram The Hon’ble Mr. Justice G. S. Sandhawalia, Chief Justice. The Hon’ble Mr. Justice Bipin C. Negi, Judge. Whether approved for reporting? For the Appellants: Mr. Varun Chandel, Additional Advocate General. For the Respondent: Mr. Anirudh Sharma, Advocate. G. S. Sandhawalia , Chief Justice (Oral) Consideration in the present appeal is sought to the judgment passed by the learned Single Judge in CWP No. 14557 of 2025, titled as Mohit & Ors. vs. State of H.P. & Ors., decided on 12.09.2025. 2. The learned Single Judge has directed consideration in terms of the order passed in CWP No. 1684 of 2024, titled as Mohit Sharma vs. State of H.P. & Ors., decided on 29.11.2024. Resultantly, while quashing the orders dated 10.05.2025, 30.05.2025 and 27.06.2025 (Annexures P-4 colly), it was directed that the respondents would consider and decide the case of the petitioners for grant of benefits 2 2026:HHC:20390 under the Revised Pay Scale Rules, 2022 in accordance with the said case. 3. Learned Counsel for the State has placed on record communication dated 22.05.2026, addressed to the Advocate General, whereby the benefits of higher pay scale has been granted in favour of the officials who have completed two years of regular service as per the office order dated 06.05.2026. The perusal of the same would go on to show that employees as such had joined on contract basis i.e. Mohit on 07.02.2020, Diksha Thakur on 20.02.2020, Jyoti Bhardwaj on 14.05.2020 and Som Krishan on 13.02.2020. 4. A perusal of the Notification dated 04.04.2026 would also go on to show that the employees who were appointed before 03.01.2022, the benefit is to be granted as such to the applicable. 5. Apparently, the petitioners have been appointed before the said date on contract basis and, therefore, the counsel for the State submits that he is not in a position to press the appeal. 6. In similar circumstances, LPA No. 71 of 2026, titled as State of H.P. & Ors. vs. Sunil Kumar, decided on 20.05.2026 and earlier in LPA No. 8 of 2026, titled as State 3 2026:HHC:20390 of H.P. & Ors. vs. Ashok Kumar, decided on 07.04.2026, we have also disposed of the appeals in similar terms. 7. Accordingly, the present appeal is dismissed, so also the pending applications, if any. (G. S. Sandhawalia) Chief Justice (Bipin C. Negi) 26th May, 2026 Judge (sanjeev)
