For the Respondent : Mr. Manish Kumar, Sr.SC-II ------- 06/Dated:16.04.2026 The instant application has been preferred by the petitioner for the following relief: - (a) For issuance of an appropriate writ(s), order(s), direction(s), particularly in the nature of Certiorari for quashing the office order no. 151 dated 05/06/2024 issued by Respondent no.5 whereby and whereunder the claim of the petitioner for grant of benefit under ACP/MACP has been rejected on the ground that he has not passed Departmental Accounts Examination. 2026:JHHC:13237 2 (b) For issuance of any other appropriate writ(s)/order(s)/direction(s) directing upon the authority concerned to grant the benefit of ACP/MACP scheme at least from the date when the petitioner has cleared his Departmental Accounts Examination. 2. Though the petitioner has argued assailing the impugned order that the ground which has been taken to the effect that he has fabricated the documents and indicating therein that he passed the departmental examination in 2016. However, he fairly submits that in the prayer itself the petitioner has prayed that at least he should get the benefit of ACP/MACP from the date he passed the examination. 3. Learned counsel for the respondent-State submits that though the petitioner has prayed that at least he should get ACP/MACP benefit from the date of passing the examination therefore, the State does not oppose to the said prayer and as per the circular itself he will get the benefit from the date of passing the examination to which there is no objection from the respondent. 4. Having regard to the aforesaid submissions, the impugned order dated 05/06/2024 issued by Respondent no.5 is hereby quashed to the extent it 2026:JHHC:13237 3 indicates that passing of examination is necessary for ACP/MACP benefits. 5. However, acceding to the prayer no.2 to get the ACP/MACP benefit at least from the date the petitioner has cleared the Departmental Accounts Examination; is allowed. 6. Having regard to the aforesaid, the instant writ application stands partly allowed and the concerned respondent is directed to calculate the benefit of ACP/MACP from the date the petitioner has passed the departmental examination. The entire exercise shall be completed within a period of 12 weeks from date of receipt of a copy of this order. 7. Accordingly, the instant writ application stands partly allowed.
