The instant application under Order 1, Rule 10(2), read with Section 151 CPC has been filed on behalf of applicants-appellants No. 2 to 4 for bringing on record the legal representatives of deceased appellant No.1-Kamla Devi and also for taking on record the amended memo of parties. 2. As per the applicants, appellant No.2-Kamla Devi had died on 10.02.2024 and left behind the present applicants as her legal representatives. Therefore, it is prayed that applicants-appellants No.2 to 4 may be ordered to be impleaded as the appellants and the name of deceased appellant No.1-Kamla Devi be ordered to be deleted from the array of parties. 3. No reply is intended to be filed to the application. 4. Heard. Having regard to the averments made in the application,which is duly supported with the affidavits of applicants/ appellants No.2 to 4 as well as death certificate of appellant No.1- Kamla Devi and copy of legal heirs certificate, the same are allowed and the name of appellant No.1- Kamla Devi is ordered to be deleted from the array of the parties as her legal representatives are already on record as appellants No.2 to 4. Amended memo of
parties, annexed with the application, is ordered to be taken on record. 5. The application stands disposed of. CMP No.11082 of 2026

The instant application under Section 151 of CPC has been filed by applicants/appellants No.2 to 4, namely, Himanshu, Manisha & Priyanka, respectively, for release of the entire balance amount of compensation, falling in the share of deceased appellant No.1-Kamla Devi and lying deposited in the Registry of this Court. 7. As per the applicants, they are in dire need of money to make preparation for the marriage of applicant-Miss Manisha. Therefore, it is prayed that the entire balance amount of compensation, along-with up-to-date interest, falling in the share of deceased appellant No.1- Kamla Devi, may be released in their favour as per their respective shares. The application is duly supported with the affidavits of the applicants. 8.
Learned counsel for the non-applicant/respondent No.2 submitted that he does not want to file any reply to the application and has no objection in case the amount is released in favour of the applicants/appellants No.2 to 4. 9. Heard. Having perused the averments made in the application, which is duly supported with the affidavits of applicants-appellants No.2 to 4, this Court finds it in the interest of justice to release the entire balance amount of compensation alongwith up-to-date interest, falling in the share of deceased
appellant No.1-Kamla Devi, in favour of the applicants- appellants No.2 to 4, in equal shares, after proper verification and identification by remitting the same to their respective bank accounts, details whereof have been given in para-13 of the application.
