The petitioner prays for quashing the order dated 19.02.2025, issued by Shiva Protection Force (P) Limited, whereby the services of the petitioner has been terminated. 3. Admittedly, the petitioner is an employee of Shiva Protection Force (P) Limited. The Government was taking manpower services from the Shiva Protection Force (P) Limited and the petitioner was one of the person who has been placed in the Settlement Office by Shiva Protection Force (P) Limited. 2026:JHHC:964 2 4. Admittedly, there is no employer-employee relationship between this petitioner and the Government and the petitioner admittedly is the employee of Shiva Protection Force (P) Limited which is evident from Annexure-9 which is the termination letter. 5. The Shiva Protection Force (P) Limited is not a State within the meaning of Article 12 of the Constitution. Even if the petitioner is terminated on the instruction of State, since the order of termination is by the employer who is not a State, the petitioner cannot maintain this writ application under Article 226 of the Constitution.
