Heard the learned counsel for the respective parties. This appeal is directed against the order dated 3.1.2026 passed by the learned Sessions Judge, Pakur in Anticipatory Bail Petition No. 536 of 2025 arising out of Pakur Malpahari P.S. Case No. 56 of 2012, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected. It has been alleged that from the crusher of Mahubul Sheikh, 47 sacks of 50 kg. each of Ammonium Nitrate were recovered. Submission has been advanced by the learned counsel for the appellant that the appellant was merely a munshi in the crusher machine of Mahubul Sheikh and the appellant has been implicated only on account of purported false affidavit sworn by him on a back date. It has further been submitted that in fact the name of the appellant has transpired on account of the statement of the witnesses namely Nayar Sheikh and Halim Sheikh. The learned counsel further submits that a perusal of the case diary would indicate that the appellant does not have any concern with the crusher machine and it was only Mahubul Sheikh who was the owner of the crusher machine and who was primarily involved in the offence. Learned Spl.P.P. has opposed the prayer for anticipatory bail of
the appellant and has submitted that the appellant had sworn a false affidavit which fact has been corroborated from the testimony of the Notary Public, Ajit Kumar Ravidas. From the affidavit, it seems that Mahubul Sheikh had let out the crusher machine to the appellant prior to the raid conducted by the police. It appears from the affidavit that it was the appellant who was let out the premises by Mahubul Sheikh. Therefore, the appellant cannot be absolved of his liability with respect to the illegal storage of huge quantity of Ammonium Nitrate.
In such circumstances, therefore, we are not inclined to grant anticipatory bail to the appellant and consequently, this appeal stands dismissed. (RONGON MUKHOPADHYAY, J.)
