This bail application has been filed on behalf of Jitendra Ram who is in custody since 13.10.2025 in connection with Garhwa P.S. Case No. 471 of 2025 for the offence registered under Section 108 of the BNS pending in the Court of learned CJM, Garhwa, is pressed into motion. As per the FIR, informant is the father of the deceased who committed suicide by hanging. The case has been lodged against the wife of the deceased and it is alleged that the petitioner was having illicit relationship with the wife of the deceased. It is submitted by the learned counsel on behalf of petitioner that no overt act has been attributed against this petitioner which drove him to commit suicide. As a matter of fact, he was an alcoholic and was not having good relationship with his wife. In any case mere adulterous relationship cannot make out an offence under Section 108 of BNS. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
