1 2026:CGHC:8305 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 1347 of 2026 1 - Nirbhay Jangade S/o Late Laxmi Narayan Jangade, Aged About 19 Years R/o Satnami Para, Katulbod Durg, Police Station Durg Mohan Nagar Durg, Tahsil And District- Durg (C.G.) ... Applicant versus 1 - State Of Chhattisgarh Through The Station House Officer, Police Of Police Station Pulgaon, District- Durg (C.G.) ... Respondent For Applicant : Mr. Anukul Biswas, Adv. For Respondent/State : Mr. Anish Tiwari, Dy. G.A. Hon'ble Shri Justice Sanjay Kumar Jaiswal Order On Board 16/02/2026 1. The applicant has preferred this first bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act, 2023 for grant of regular bail as he is arrested in connection with Crime No.402/2025, registered at Police Station – Pulgaon, District- Durg (C.G.) for offence punishable under Sections 103(1), 61(2), 249, 311 & 238 of BNS, 2023. 2. As per the prosecution’s case, co-accused Akash Baghel and deceased Gangotri Jangde were collecting money from individuals under the pretext of providing them government employment. Fearing exposure when the deceased summoned these individuals for an interview on HEERA LAL SAHU Digitally signed by HEERA LAL SAHU Date: 2026.02.17 10:25:17 +0530 2 20.09.2025, the present applicant along with other co- accused persons, allegedly conspired to commit her murder. In furtherance of this conspiracy, co-accused Akash and the present applicant Nirbhay took the deceased on a motorcycle to the spot, where they strangled her with a belt and struck her with a stone, causing her death. Based on this, offence has been registered against the present applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. He further submits that there is no eyewitness in the present case, and the prosecution case is based solely on circumstantial evidence, which is weak, uncorroborated and insufficient to prima facie establish the involvement of the applicant in the alleged offence. One co- accused Hemlata Banjare has already been granted bail by this Court in MCRC No. 10454 of 2025 on 12.01.2026, therefore, the present applicant may also be enlarged on bail on the basis of similar facts and circumstances. The applicant is in jail since 25.09.2025, and the trial is likely to take time to be finalized. Therefore, it is prayed that the applicant may be enlarged on bail. 4. Per contra, learned Counsel appearing on behalf of the State opposes the bail application and submits co-accused Hemlata Banjare was granted bail on the facts that she is advocate by profession, there is no direct evidence against her and there is no seizure from her in the case, but the facts against the present applicant is different that the applicant played an active role in the offence of murder of Gangotri Jangde and there is a seizure of hand bag of the deceased from the present applicant; therefore, at this 3 stage, looking to the gravity of the offence, the applicant may not be released on bail. 5. I have heard learned Counsel appearing for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case, and overall evidence collected by the prosecution against the applicant, and also looking to the gravity of the offence, at this stage, without commenting on the merits of the case, I am not inclined to release the applicant on bail. Accordingly, the bail application filed under Section 483 of BNSS, 2023, is rejected. 7. Office is directed to sent a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/- (Sanjay Kumar Jaiswal) Judge H.L. Sahu
