Learned High Court Government Pleader takes notice for respondent Nos.1 to 3. Notice to respondent No.4 is not necessary for the following reasons.

The grievance of the petitioners is directed towards the impugned notices commencing from Annexure-H and Annexure-L series issued by the respondent-Tahsildar, Sakleshpura Taluk, calling upon the petitioners to furnish information and say as to why action should not be taken against the petitioners to remove the encroachment said to have been made by the petitioners on the 'pathway/nakashe kanda kaludari' in Survey No.45/1 of Hennali Village, Kasaba Hobli, Sakleshapura Taluk.
3. Having regard to the impugned notices, the learned High Court Government Pleader is right in his submission that the petitioners will have to answer to the notice and the Tahsildar is required to take into consideration the objections filed by the petitioners and documents that would be furnished by them.

4. Consequently, the writ petition stands disposed of, directing the petitioners and the respondent-Tahsildar to consider the impugned notices as show cause notices issued to the petitioners. If the petitioners have not already filed objections, they shall do so within a period of 15 days from today along with the requisite documents. The Tahsildar is also
directed to take into consideration the objections that are filed by the petitioners, consider the documents, if need be, conduct a joint survey in the presence of the petitioners and thereafter proceed only in accordance with law.
5. Needless to observe that until a decision is finally taken by the Tahsildar after affording an opportunity of hearing to the petitioners, no precipitative action shall be taken against the petitioners.
Ordered accordingly.
