In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Nikhil Kumar, who has been accused in NCB Crime No.III/NCB/DDN/08/2025 under Sections 8/18/23/27/29 of the NDPS Act, 1985, at P.S. Regional Office, Narcotic Control Bureau, Zonal Unit, Dehradun. The Applicant is in judicial custody since 04.11.2025. 4. On 03.10.2025, a DTDC Express Limited Miglani Enterprises, Shastri Market, Kichha, Udham Singh Nagar, a team form by the NCB intercepted a parcel for Canada, and upon interrogation it was found that parcel was received from Vishal Kumar S/o Mahendra Pal. Upon investigation, a sticky substance and a plastic foil was found in a carton, which was tested and found positive for opium. 5. Learned counsel for the Respondent submits that the owner of the DTDC Express Ltd. Miglani Enterprises, clearly identified the Applicant as the person who booked the parcel on 21.09.2025. 6. This Court notes that the booking of the parcel by the Applicant is established through CCTV footage, identification, and misuse of Aadhaar, which proves his role beyond doubt.
