The appellant states that they have taken every effort to serve the notice on respondent No.2. However, his address could not trace out by the appellant Insurance Company. The appellant states that for deciding the present application, the notice to respondent No.2 be dispensed with. Appellant states that while serving the notice on appeal, they will take all steps to see that the notice will be served on respondent No.2 on merit. 2. Learned Counsel appearing for respondent No.1 has no objection for condonation of 41 days caused in filing the appeal. In view of these circumstances, the notice on respondent No.2 on the application for condonation of 59 caf 1440-2026.odt 2 delay is stand waived. 3. After perusal of the averments made in the application, I am satisfied that sufficient reasons are stated for condonation of 41 days delay. Hence, the application is allowed. 4.
