Also heard, MR. B. Deka, learned CGC, Mr. A.I. Ali, learned Standing Counsel for the ECI, J. Payeng learned Standing Counsel, FT and Mr. H.K. Hazarika. 2. Upon instructions, Mr. A. Ali, learned Counsel for the petitioner has submitted that the petitioner namely Jarifuddin Ahmed @ Md. Jurubuddin has died on 16.02.2025, during the pendency of this writ petitioner. In this regard, he has produced the photocopy of the death certificate. The certificate issued on 06.03.2025 is written on record. 3. The learned Counsel for the petitioner has submitted that along with the death certificate, he has received oral instructions from the son of the deceased petitioner that this writ petitioner may be closed. 4. Notwithstanding that the instructions to the learned Counsel for the petitioner is to withdraw this, writ petition on death of the petitioner, but as
Page No.# 3/3 consequences are attached to the opinion dated 07.12.2018, passed by the learned member, Foreigners Tribunals No.3, Kamrup(M), Guwahati in FT(C) No. 156/2017, the learned Counsel for the petitioner is put to notice about the consequences. 5. As the prayer is renewed, the case is dismissed on abatement on the death of the petitioner, namely Jarifuddin Ahmed@ Md. Jurubuddin. In other words, the case is abated on the death of petitioner, Jarifuddin Ahmed @ Md. Jurubuddin.
