JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused No.6 is before this Court calling in question registration of a crime in Crime No.20/2026, pending before the I Additional Chief Judicial Magistrate, Bengaluru, for the offences under Sections 115(2), 118(1), 190, 191(2), 126(2), 189(2), 191(3) 351(2) and 352 of the BNS, 2023. 2. Learned counsel for the petitioner and respondent No.2 would in unison submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms - 3 - HC-KAR NC: 2026:KHC:16817 CRL.P No. 3755 of 2026 and conditions. The parties have filed an application under Section 359(8) of the BNSS, 2023 along with a joint affidavit before this Court to that effect. 3. Joint affidavit of the parties reads as follows: JOINT AFFIDAVIT XXXXXX “1. That the Petitioner and the Respondent are parties in the case bearing Crime No. 20/2026 Registered by the respondent police pending on the file of Sadashivanagar Police Station. pending before the Hon'ble 1st Addl chief judicial magistrate court at Bengaluru. Court for the alleged offences under Sections 115(2), 118(1), 190, 191(2), 126(2), 189(2), 191(3), 351(2), 352 of Bharatiya Nyaya Sanhita, 2023. 2. That due to certain misunderstandings and personal differences between the parties during the course of their studies, the above-mentioned FIR came to be lodged. 3. That with the intervention of elders, well-wishers and common friends, the parties have now amicably settled the dispute outside the court and resolved all their differences and want to lead a peaceful life with good terms. 4. That the Petitioner and the Respondent have entered into the settlement voluntarily, out of their free will, without any force, coercion, undue influence or pressure from anybody. 5. That in view of the above settlement, the Respondent No.2 the defacto complainant has no objection if the proceedings in Crime No.20/2026 registered by the respondent police as mentioned - 4 - HC-KAR NC: 2026:KHC:16817 CRL.P No. 3755 of 2026 above are quashed or disposed of by this Hon'ble Court. 6. That both parties undertake to maintain peace and cordial relations in future and no further claims or disputes remain between them in respect of the subject matter of the case. 7. That this Joint Affidavit is filed before this Hon'ble Court to place on record the amicable settlement between the parties and to request the Hon'ble Court to quash the FIR dated 17.02.2026 registered by the respondent police in the interest of justice, WHEREFORE, the Deponents most respectfully pray that this Hon'ble Court may kindly take this Joint Affidavit on Record and quash the FIR dated 17.02.2026 in Crime no.20/2026 registered by the respondent police in the interest of justice.” In the light of the afore-quoted joint affidavit of the parties, I deem it appropriate to terminate the proceedings against the petitioner in the subject petition, as the allegations are not against the State. 6. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. - 5 - HC-KAR NC: 2026:KHC:16817 CRL.P No. 3755 of 2026 (b) The impugned crime in Crime No.20/2026, pending before the I Additional Chief Judicial Magistrate, Bengaluru, qua the petitioner, stand quashed.
