JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in Crime No.108/2025, pending before the IV Addl. Chief Metropolitan Magistrate at Bengaluru, for the offences under Sections 316(2) and 318(4) of the BNS 2023. 2. Heard Sri.Sanjay H Sethiya, learned counsel appearing for the petitioner, Sri.Anoop Kumar, learned HCGP appearing for respondent No.1, Sri.Ram M.K., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have - 3 - HC-KAR NC: 2026:KHC:19932 CRL.P No. 2146 of 2026 filed a compromise petition by way of Joint Memo along with Joint Affidavit. The Joint Affidavit reads as follows: “We, Jeeran R. Sakaria, S/o. Rajendra Kumar, aged about 35 years, Residing at No.1 and 2, 4th Floor, MM Complex, Bettappa Lane, CT Street Cross, Bengaluru-560002, Mohammed Salman, S/o. Chandrashekar Raju, aged about 43 years, Residing at No.4, 3rd floor, Neharupuram, 1st Cross, Near Mutyalam Temple, Bengaluru-560001, do hereby solemnly affirm and state on oath as follows: 1. We state that, we the Petitioner, the complainant who is Respondent No. 2, we are well conversant with the facts and circumstances of the above petition, and hence we are swearing this joint affidavit. 2. We state that, the Petitioner is arrayed as Accused person in FIR in Crime No.108/2025 dated 12.09.2025 registered by the 1st Respondent and pending on the file of the IV Additional Chief Metropolitan Magistrate, Bengaluru, for the alleged offences under Sections 316(2) and 318(4) of the Bharatiya Nyaya Sanhita, 2023. 3. We state the above petition is filed by the us the petitioners to quash the F.I.R in Crime No.108/2025 dated 12.09.2025 registered by the 1st Respondent and pending on the file of the IV Additional Chief Metropolitan Magistrate, Bengaluru against the petitioner for the offence punishable under Sections 316(2) and 318(4) of the Bharatiya Nyaya Sanhita, 2023. 4. We state that during the time of investigation 1st Respondent has recovered the gold as mentioned in order sheet in Crime No. 108/2025 and the same is handed over to the 2nd Respondent. Further, the Respondent No.2 accepts the same as full and final settlement. Under these circumstances, we have entered into a compromise as full and final settlement. 5. We state that the in view of the full and final settlement, the Respondent No. 2 has duly agreed to withdraw the case filed against the Petitioner. - 4 - HC-KAR NC: 2026:KHC:19932 CRL.P No. 2146 of 2026 6. We state that, if this compromise petition is not accepted, we will be put to greater hard ship and inconvenience which cannot be compensated in any manner. 7. We state that if the accompanying joint memo is not allowed a lot of hardship will be caused us. WHATSOEVER, stated above is true and correct to the best of our knowledge and belief.” 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of compromise petition being filed by way of Joint Memo along with Joint Affidavit and offences not being against the State, I deem it appropriate to accept the Compromise Petition and Joint Affidavit and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in Crime No.108/2025 pending before the IV Addl.
