1. Heard Mr. Ramanik Pawar, learned Advocate for the Applicant.
2. By the present Application the Applicant has sought for the following substantive relief in terms of prayer clause (i) :- i. That this Hon'ble Court may kindly enlarge the present Applicant Yuvraj Ravsaheb Mali, Accused No. 2, on bail in connection with C.R. No 326 of 2025 registered with Jaysingpur Police Station, District Kolhapur, for the offences punishable under Sections 103(1), 61(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and other allied provisions, on such terms and conditions as this Hon'ble Court deems fit and proper;
3. After having heard the matter for some time, Mr. Ramanik Pawar, learned Advocate for the Applicant, on instructions from the Applicant, seeks leave to withdraw the present Application with liberty Arjun 1
12-BA-885-2026.doc to file a fresh Bail Application before the Trial Court on the ground of change in circumstances or after a period of 1 year from today if there is no progress in trial.
4. The request made by Mr. Ramanik Pawar, learned Advocate for the Applicant, is not opposed by Mr. A. S. Shalgaonkar, learned APP for the Respondent – State.
5. In view of the statement made by Mr. Ramanik Pawar, learned Advocate for the Applicant, leave is granted to withdraw the present Application with liberty as prayed.
6. If a fresh Bail Application is filed by the Applicant before the Trial Court on the grounds of change in circumstances or after expiry of a period of 1 year from the next date fixed in the Sessions Case No. 51 of 2025 (i.e. 29.09.2026) if there is no substantial progress in the trial, then, same be considered on its own merits and in accordance with law.
7. Bail Application No. 884 of 2026 is disposed of as withdrawn.
