The petitioner has led this Writ Petition against the arbitrary and illegal act of the respondent No..5 regarding proposed constructions 2 of complex of numerous shops in front of the commercial plot of the petitioner, thereby causing complete blockage of street and obstruction to access to the main road. 2. The brief facts of the case are that the respondent No.5 has issued an auction notice dated 5-12-2025 (Annexure P/1) for auction of 27 shops and invited potential buyers for booking of shops, prior to its construction at Ward No.15, By-pass road, in front of Civil Court Kurud, beside Krishna Fertilizer opposite Mandi Gate, Kurud, District Dhamtari (CG) which is directly extending across the open area in front of the petitioner's plot that is located opposite to the Mandi gate. 3. Learned counsel for the petitioner seeks permission of this Court to withdraw this Writ Petition with liberty to make a fresh representation before the authority or he may take other alternative remedy available to him under the law. 4.
