The order dated 21 April, 2026 stands modified to dispense with the presence of the respondent no. 3 who also happens to be the concerned District Magistrate, Darjeeling. 2. The grievance of the petitioners is directed against inaction of the respondent authorities in acting on the basis of a complaint alleging illegal and unauthorized construction. 3. Pursuant to an order dated 21 April, 2026, the respondent no. 3 has filed a Report dated 25 April, 2026. 2 4. A copy of the report be kept with the records. 5. It appears from the report that after conducting an enquiry the respondent no. 3 has categorically come to a finding that there are three distinct deviations at the subject premises. 6. In view of the above, WPA/550/2026 stands disposed of by directing the concerned statutory respondents to take all corrective and remedial measures in terms of the Report dated 25 April, 2026 within a period of one month from the date of passing of this order. 7. Liberty is granted to the writ petitioner to file a fresh proceeding in accordance with law, if so advised and if the subsequent events so warrant. (RAVI KRISHAN KAPUR, J.)
