For Petitioner(s): Ms.U.Santhana Lakshmi For Respondent(s): Mr.R.Lokeshwaran For R1, R2 & R7 To R9 R3, R4, R5 & R6 - Service Awaited ORDER Challenging the impugned order passed in IA No. 14 of 2025 in OS No. 6758 of 2005 passed by the XVI Assistant Judge, City Civil Court, Chennai, the Revision Petitioners/defendants 6 and 7 have preferred this Civil Revision Petition. 2.Before the trial court, the Revision Petitioners/defendants 6 and 7 have filed the application under Sec.33 and 33A of Indian Stamp Duty Act, 1899 in I.A.No.14 of 2025 seeking to impound the document dated 10.06.1996 executed by 1st and 3rd plaintiff in favour of 1st defendant for the value of Rs.45,000/- for the deficient stamp duty and penalty and also filed another application under Sec.65(a) of the Indian Evidence Act r/w Sec.151 of C.P.C. in I.A.No.15 of 2025 seeking to permit the revision petitioners/defendants 6 and 7 to mark the photocopy of the documents annexed in the petition. On hearing both sides, the trial judge allowed the application filed in I.A.No.15 of 2025 and in respect of __________ Page3 of 5 https://www.mhc.tn.gov.in/judis CRP No. 1219 of 2026 impounding the document, the trial judge dismissed the application filed in I.A.No.14 of 2025 holding that the original document was not produced. Aggrieved over that, the revision petitioners have preferred this Civil Revision Petition. 3. The learned counsel for revision petitioners/defendants 6 and 7 would submit that they would produce the original document before the trial court. 4. Considering his submissions, liberty is granted to the revision petitioners/defendants 6 and 7 to produce the original document before the trial court and to impound the document with the permission of the court in the manner known to law. With that liberty, this Civil Revision Petition is disposed of. No costs.
