JUSTICE CHILLAKUR SUMALATHA - 3 - HC-KAR NC: 2026:KHC:7611 WP No. 33588 of 2025 ORAL ORDER Heard Sri.Dharani Krishna D., learned counsel for the petitioner as well as Sri.Sunil T.M., who represents Sri.Arun Govindraj, learned counsel on record for respondent. 2. Petitioner Mr.Vivek George Jocob and respondent Ms.Elizabeth George are present in person. Likewise, child by name Master Kevin George is also present. 3. To know the wishes of the child, this Court interacted with the child. Child appears matured. He states that he is staying with his mother. He also informed the Court that he is studying 4th Standard and he has to pursue his studies. He further told that he has seen his father two weeks back. The child reported that it will be convenient for him to spend time with his father at the club house located near his house once in a month for about 3 to 4 hours. - 4 - HC-KAR NC: 2026:KHC:7611 WP No. 33588 of 2025 4. On hearing the wish of the child, both the learned counsel graciously requested this Court to dispose of the writ petition accordingly. Thus, the writ petition is disposed of with the following: ORDER i) The order that is rendered by the Court of VI Additional Principal Judge, Family Court, Bengaluru on I.A. No.IV in G&WC No.431/2023 dated 12.06.2025 is modified. ii) Petitioner is permitted to visit the child and spend time with him on every second Saturday between 09.00 a.m. and 01.00 p.m. at the club house which is located near the house of the respondent. iii) Respondent to drop the child at the club house at 09.00 a.m. and to pick up the child at 01.00 p.m. iv) Petitioner shall not converse with the child anything against the respondent during such time. - 5 - HC-KAR NC: 2026:KHC:7611 WP No. 33588 of 2025 v) Petitioner shall not take any photographs or videographs during the said time except with the permission of the respondent. vi) This arrangement shall continue till the disposal of G&WC No.431/2023. vii) Liberty is granted to both parties to move necessary application before the Family Court, Bengaluru, in case there are change of circumstances.
