GP FOR FINANCE PLANNING The Court made the following: 4 VS,J W.P.No.24369 of 2026 ORDER: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue an appropriate Writ, order or direction mostly one which is in the nature of a Writ of Mandamus declaring the action of the Respondents in non-payment of the final bills due to the Petitioner even after finalizing the bills, payable in relation to the works executed in pursuance of work Providing WMM and DBM Repair Work @ Undavalli Bridge and in Route No 4 for Hon'ble Prime Minister Program for an amount of Rs. 4,73,454, as illegal, arbitrary, unjust, unfair, unreasonable and unconstitutional and consequently direct the Respondents to make the payment of amount due to the Petitioner in respect of above execution of work along with the Earnest Money Deposit (EMD) forthwith….” 2. The case of the petitioner is that pursuant to the work order dated 22.04.2025, the petitioner has entered into an agreement with the 4th respondent on 26.04.2025 for executing the work of ‘providing WMM and DBM repair work @Undavalli Bridge and in Route NO.4 for Hon'ble Prime Minister Program’ and accordingly, the petitioner is said to have executed the work as per the terms and conditions of the agreement. Subsequently, when the petitioner approached the respondent authorities seeking payment for the work executed by him, the respondent authorities have been delaying such payment on one pretext or the other. Aggrieved by the same, the present writ petition is filed. 5 VS,J W.P.No.24369 of 2026 3. It is the contention of the petitioner that even though the respondents admitted that the petitioner is entitled for payment, no payment is being made. The petitioner contends that such non-payment of money is clearly arbitrary and high-handed requiring the interference of this Court. 4. This Court, in various orders, including the judgment of a learned Single Judge of this Court dated 05.10.2021 in W.P.No.10038 of 2021 and batch had taken the view that such non-payment of dues is arbitrary and that such dues need to be cleared by the respondents at the earliest. 5. On the other hand, learned Standing Counsel for the respondents furnished a copy of instructions issued by the 4th respondent dated 15.09.2026 wherein it is stated that an amount of Rs.4,49,058.18/- is to be paid to the petitioner for the works executed by him and that the same would be paid as soon as funds are received from the APCRDA. 6. In view of fact that the amounts payable to the petitioner are admitted by the respondents, instead of keeping the writ petition pending, this writ petition is disposed of and the respondents are directed to pay Rs.4,49,058.18/- to the petitioner, within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs. 7. As far as interest component is concerned, if there is any subsisting clause in the agreement/work order envisaging payment of interest 6 VS,J W.P.No.24369 of 2026 upon any amount which is due and payable, the same is binding upon both the parties.
