For Petitioner(s): Mr.T.Arul For Respondent(s): Mr.P.Dhileepan Government Advocate (Criminal side) ORDER The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 316 (2) and 318 (2) of B.N.S. 2023, in Crime No.53 of 2026, on the file of the respondent Police, seek anticipatory bail. https://www.mhc.tn.gov.in/judis CRL OP No. 6884 of 2026 __________ Page2 of 6 2. The case of the prosecution is that the defacto-complainant pledged 418 grams of gold jewels and received a loan of Rs.20,00,000/- from the petitioners. Although the complainant is ready to repay the principal and interest, the petitioners have failed to return the pledged jewels. Hence, the complaint. 3. The learned counsel appearing for the petitioners would submit that the defacto-complainant pledged 418 grams of gold jewels and received a loan of Rs.20,00,000/-. However, the defacto-complainant did not repay the loan amount with interest and insisting upon the petitioners to return the pledged jewels. He further submits that the petitioners are innocent persons and they had been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioners. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police strongly opposed this application on the ground that the petitioners had again re-pledged the jewels to some third party and had not returned the gold jewels though the defacto-complainant is willing to pay the principal and interest. 5.Taking into consideration of all the allegations against these petitioners, the nature of complaint and that the custodial interrogation of the petitioners is https://www.mhc.tn.gov.in/judis CRL OP No. 6884 of 2026 __________ Page3 of 6 not necessary at this length of time, this Court is inclined to grant anticipatory bail to the petitioners, subject to certain conditions. 6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date on which the order copy is made ready, before the learned XVII Metropolitan Magistrate Court, Saidapet, Chennai, on condition that the petitioners shall execute a bond for a sum of Rs.25,000/- each (Rupees Twenty Five Thousand only), with two sureties each, for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions: (a) If the petitioners fail to surrender before the concerned learned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled; (b) The sureties shall affix their photographs and left thumb impression in the application for surety ship (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity; (c) The petitioners shall report before the respondent police daily at 10.30 am and 5.30 pm. until further orders; (d) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioners in accordance with law as if the conditions have been imposed and the petitioner released on https://www.mhc.tn.gov.in/judis CRL OP No. 6884 of 2026 __________ Page4 of 6 anticipatory bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v.
