This bail application has been filed on behalf of Amit Kumar @ Amit Kumar Das @ Amit Das who is in custody since 23.07.2025 in connection with Jirwabari P.S. Case No. 207 of 2024 for the offence registered under Sections 103(1), 238 and 3(5) of the BNS, 2023 pending in the Court of CJM, Sahibganj, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that FIR is lodged against one named accused person and he is not named in the FIR. The only material against him is the confessional statement of the co-accused. Neither there is direct eye witness nor circumstantial evidence against him Learned A.P.P. for the State opposed the prayer for bail and submitted that there is no other witness except the confessional statement of the co-accused. However, from para 88 of the supplementary case diary, it appears that on his disclosure statement the Gamcha that was used for strangulating the deceased was recovered.
