GP FOR REVENUE The Court made the following: ::ORDER :: Since the issue involved in both these writ petitions is similar, they are disposed of by this common order. Page 6 of 8 2. Heard Ms. Kota Krishna Deepthi, learned counsel for the petitioners; Sri P. Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj, for respondent No.1, Ms. P. Usha, learned Assistant Government Pleader for Revenue, for respondents 2 to 4, and Sri Chaitanya, learned counsel representing Sri Y. Koteswara Rao, learned standing counsel for respondent No.5. 3. The petitioners filed the above writ petitions to declare the action of respondents 4 and 5 in attempting to dispossess them from their house sites in survey No.196/2, Jaggampeta Gram Panchayat, East Godavari District, without cancelling D-form pattas granted in their favour by the then Tahsildar, as illegal and arbitrary. 4. W.P.No.8142 of 2026 was listed on 24.03.2026, and an interim order was granted by this Court, directing respondents 4 and 5 not to interfere with the petitioner’s possession in respect of house sites in survey No.196/2 Jaggampeta Gram Panchayat, East Godavari District, without following due procedure. 5. Thereafter, W.P.No.9336 of 2026 was listed on 08.04.2026, and the learned Assistant Government Pleader for Revenue submitted the instructions of respondent No.4-Tahsildar. 6. As seen from the instructions of respondent No.4, the authority has resumed an extent of Ac.4-585 cents in survey No.196/2, Jaggampeta village, East Godavari District, since the beneficiaries, including the petitioners herein, failed to construct houses. Since the date of resumption was not mentioned in the instructions, the writ petition was directed to be listed today along with W.P.No.8142 of 2026. Page 7 of 8 7. Today, when the matters are taken up, the learned Assistant Government Pleader for Revenue produced a copy of the proceedings issued by respondent No.4 vide Rc.No.E/177/2025 dated 11.03.2026. A copy of the said proceedings is handed over to the learned counsel for the petitioners across the bar. 8. Given the resumption proceedings, dated 11.03.2026, issued by respondent No.4, the grievance of the petitioners that respondents 4 and 5 are attempting to dispossess them of their lands is misconceived. The petitioners ought to have challenged the resumption proceedings passed by the Tahsildar, Jaggampeta, before the appropriate authority. This Court does not find any merit in the writ petitions, and they are liable to be dismissed. 9. Accordingly, these writ petitions are dismissed. However, this order will not preclude the petitioners from challenging the proceedings issued by respondent No.4 vide Rc.No.E/177/2025 dated 11.03.2026, before the appropriate Court. No costs.
