This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.497/2025 registered at Police Station Gudiyari, District Raipur (C.G.) for the offence punishable under Section 306 of I.P.C. 2. Case of the prosecution, in brief, is that the newly wedded wife of the present applicant allegedly committed suicide in her matrimonial home. GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.03.27 12:53:34 +0530 2 Pursuant thereto, the concerned police, after conducting due investigation, registered the F.I.R. and arrested the present applicant. Thereafter, the prosecution has filed the charge-sheet before the competent Court of law. 3. Learned counsel for the applicant submitted that the FIR of the incident has been lodged after 18 months. He would submit that charge sheet has been filed, the applicant is in jail since 09/12/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and she would submit that charge sheet has been filed in this case. She would submit that before lodging of the present FIR, a case was registered against the applicant under Section 376 IPC which was lodged by the deceased and the said case entered into a compromise after the applicant married the deceased and two months thereafter the deceased committed suicide because of the harassment caused by the applicant and at the time the deceased was six months pregnant. She would submit that considering the conduct of the applicant, he is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, further considering the fact that prior to the present FIR, the deceased had lodged a case under Section 376 IPC against the applicant, which was later compromised upon their marriage, however, after two months of the marriage, the deceased, who was six months pregnant, committed 3 suicide allegedly due to harassment by the applicant, considering the gravity of offence, the direct nexus between the applicant’s conduct and the death of the deceased, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Chirag Garun involved in Crime No.497/2025 registered at Police Station Gudiyari, District Raipur (C.G.) for the offence punishable under Section 306 of I.P.C., is rejected. 8.
