Judgment / Order
[2026:RJ-JP:27646-DB] (2 of 2) [HC-178/2026] 20/07/2026 Pursuant to order of this Court dated 07.07.2026, Shri Prakash Jyoti Upadhyay-the Superintendent of Police, Bhiwadi is present through VC. Learned Government Advocate cum Additional Advocate General has submitted the status report dated 20.07.2026 furnished by the Station House Officer, Police Station Kishangarh Bas, District Khairthal-Tijara. The report is accompanied with an
order dated 06.05.2026 passed by the Hon'ble High Court of Punjab and Haryana in Criminal Writ Petition No.5365/2026 which reflects that the alleged detenu, namely, Ms. "R" has married a boy, namely, Rihan Khan claiming themselves to be major and were granted protection. However, learned counsel for the petitioner contends that the girl is minor. In view of the order dated 06.05.2026 passed by the Hon'ble High Court of Punjab and Haryana in Criminal Writ Petition No.5365/2026, prima facie, she appears to be major and under protection of the Hon'ble Court's order treating her to be married, we deem it just and proper not to make a roving inquiry as to the age of Ms. "R" in our writ jurisdiction. On that premise, we do not find it to be a case of illegal detention. Resultantly, this habeas corpus petition is dismissed.
