CORAM:
HON'BLE MR. JUSTICE MANOJ JAIN
J U D G M E N T (oral)
1. The petitioner is aggrieved by order dated 31.12.2025 whereby his request for grant of furlough has been declined, while observing as under:-
“iii) That as per Para 1223(i) of Delhi Prison Rules 2018 which states that “the prisoner must have a good conduct in prison and should have earned reward in last 03 Annual Good Conduct Remission and continue to maintain good conduct.” In the present matter the convict has not earned 03 AGCR continuously. Therefore, he is not eligible to grant or furlough.”
2. There is a punishment ticket issued to the petitioner herein on
14.02.2025.
3. On 14.02.2025, during routine checking inside the jail, the internal staff of the jail found petitioner-Bal Kishan @ Karvaya, in an intoxicated state and urine cassette test was conducted, which indicated presence of BZO (Benzodiazepine) in his urine.

punishment ticket was, accordingly, handed out to him and, since he accepted his misconduct and realized his mistake, his mulakat facility was stopped for 30 days.
5. The punishment ticket was subject to the appraisal of learned District and Sessions Judge.
6. Admittedly, the appraisal has yet not been done.
7. Since based on the abovesaid punishment ticket, the mulakat facility, which also is a valuable right for any jail inmate, had been stopped for 30 days, denying benefit of furlough would amount to double jeopardy. Moreover, the impact of the punishment has already expired and as per
learned counsel for the applicant, there is no further misconduct on his part.
8. In view of the above, the present petition is disposed of with the direction to Competent Authority to consider the request of furlough afresh, without being influenced by the abovesaid punishment ticket.
9. A copy of this order be sent to Jail Superintendent for information and compliance.
