1. The applicant has preferred this Fourth Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 359/2024, registered at Police Station Pachpedi, District-Bilaspur(CG) for the offence
2 punishable under Section 103(1) and Section 3(5) of BNS, 2023. 2. First Bail Application bearing MCRC No. 329 of 2025 was dismissed as withdrawn by this Court vide order dated 17.01.2025 and Second Bail Application bearing MCRC No. 6190 of 2025 was dismissed on merits by this Court vide order dated 06.08.2025. Third Bail Application bearing MCRC No. 6983 of 2025 was dismissed on merits by this Court vide order dated 03.09.2025. 3. The prosecution story in brief, is that, the applicant along with other co-accused persons have committed an offence punishable under Sections 103(1) and 3(5) of BNS, 2023 by causing grievous injuries to the deceased (Babulal Jangde) by means of iron rod and Stick. Based upon report, FIR was registered and applicant has been arrested. 4. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. FIR was registered against the accused Dhannu Kathle and Suresh Kathle but subsequently the present applicant has been implicated in this case. He further submits that 13 witnesses have been examined. The applicant is in jail since 25.10.2024 and trial is likely to take some time for conclusion, hence applicant may be released on bail. 5. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the
3 applicant. 6. I have heard learned counsel for the parties and perused the case diary. 7.
Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, there is no substantial change in the circumstances of the case, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Suresh Kathle involved in Crime No. 359/2024 under Section 103(1) and 3(5) of BNS, 2023 at Police Station-Pachpedi, District- Bilaspur, Chhattisgarh, is rejected. 8. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously preferably within a period of 4 months in accordance with law, if there is no legal impediment. 9. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
