Heard both the sides. This bail application has been filed on behalf of Niranjan Gorai who is in custody since 17.09.2025 in connection with Nimdih P.S. Case No. 53 of 2025 for the offence registered under Sections 318(4), 338, 336(3), 340(2), 274 and 275 of the BNS, 2023 and Sections 47(a), 47(b), 47(c)/52 and 55 of Excise Act pending in the Court of learned ACJM, Chandil, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that about 115 liters of illicit liquor without any valid paper was seized from a tempo and this petitioner was helper along with the owner-cum-driver of auto. It is submitted that he has no criminal antecedent and was not involved in the illicit trade of liquor and the owner of the tempo has already been granted bail by this Court. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
