2. Mr. D.C.S. Rawat, learned counsel with Mr. Kamal Pandey, learned counsel for the respondent.
3. By means of present Transfer Application under Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant has sought the following reliefs :-
“It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to allow the instant transfer application and transfer the Misc. Criminal Misc. Case No. 46 of 2024 'Katherine Jane Vs. Piyush Kumar' filed under section 125 of Cr.PC, pending before the court of Judge, Family Court, Almora, District Almora to the any other court of Roorkee, District Haridwar having jurisdiction of the same, or to pass any such other order which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case, otherwise the applicant shall suffer irreparable loss and injury.”
4. The applicant has filed proceedings under Section 125 of the Cr.P.C. before the learned Judge, Family Court, Almora against the respondent,

2026:UHC:7533 which was registered as Criminal Misc. Case No. 46 of 2023, Katherine Jane vs. Piyush Kumar. The said proceedings are pending before the said court.

The applicant has stated that presently she is residing in Himachal Pradesh and is unable to attend the court proceedings before the Family Court, Almora and seeks the transfer of the said proceedings to District Haridwar. She further states that the applicant has to travel approx.400 kms. to contest the case before the Family Court, Almora for attending the court proceedings.
6. The inconvenience as expressed by the applicant can be averted if she is permitted to join the proceedings through video conferencing and only on those dates where her personal presence would be required, she may travel to Almora.
7. Hence, the Transfer Application is disposed of with the liberty to the applicant to appear online through video conferencing, except on those particular dates on which her personal appearance is required.
8. The Transfer Application is disposed of accordingly.
