Order 13/07/2026
1. The present writ petition has been filed by the petitioner challenging order dated 29.05.2018 passed by the Board of Revenue, Ajmer in review petition, whereby application for review/recall of order dated 04.05.2018 passed by the Board of Revenue in second appeal has been dismissed. Apart from above, the petitioner has also challenged orders dated 04.05.2018 passed by the Board of Revenue and 16.10.2017 passed by the
[2026:RJ-JP:26352] (3 of 4) [CW-12203/2018] Divisional Commissioner, Jaipur as well as order dated 25.06.2016 passed by the Sub-Divisional Magistrate, Sambhar Lake, Jaipur. The case set up by the petitioner is that he is khatedar of Khasra No.126/1 of Village Bhikhawas (Khejadawas), Tehsil Phulera, District Jaipur, however, an order under Section 136 of the Rajasthan Land Revenue Act, 1956 (hereinafter to be referred as 'the Act of 1956') was passed by the Court of Sub-Divisional Officer, Sambhar Lake, Jaipur for correction of entries as well as map and as per the petitioner, such order was since affecting his vested rights, therefore, it could not have been passed without giving opportunity of hearing to the petitioner in view of the mandatory provisions of Section 136 of the Act of 1956. Against such order, the petitioner preferred appeal before the Divisional Commissioner and on remaining unsuccessful, he further approached the Board of Revenue by way of filing second appeal. However, second appeal was also dismissed and the review application has also not been entertained and came to be dismissed vide order dated 29.05.2018. Learned counsel submits that fall out of all such orders is that the petitioner's rights have been prejudiced without affording any opportunity of hearing to the petitioner.
3.
Learned counsel for the respondents opposed the writ petition and submitted that there is a concurrent finding of the three Courts that the order under Section 136 passed by the Sub- Divisional Officer is not in relation to any of the land of the petitioner. Therefore, petitioner has got no right to challenge such
order. Under these circumstances, learned Courts below have
[2026:RJ-JP:26352] (4 of 4) [CW-12203/2018] committed no mistake whatsoever in dismissing the appeals and review application filed by the petitioner.
4. Heard learned counsel for the parties and perused the material available on record.
5. On perusal of appellate order passed by the Divisional Commissioner on an appeal filed by the petitioner against order of Sub-Divisional Officer of application under Section 136 of the Act of 1956, it came out that a categorical finding has been given by the Appellate Authority that the order dated 25.06.2016 passed by the Sub-Divisional Officer is not at all related with any of the land of the petitioner and such finding has been maintained by the Board of Revenue in second appeal as well as in review petition.
6. Under these circumstances, petitioner has utterly failed to point out as to how, he is aggrieved by the order under Section 136 passed by the Sub-Divisional Officer. In view of above, this Court does not find any ground to interfere in the impugned order, and the writ petition filed by the petitioner is hereby dismissed.
7. Pending application(s), if any, also stand(s) disposed of.
