JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks the following reliefs: “a) Issue a Writ of Certiorari, quashing the Order of suspension dated 02.12.2025 bearing No.B12(1)PR/08/25-26 passed by Respondent No.3 (Annexure – ‘A’) and the consequential actions in pursuant to thereof as arbitrary & illegal; and b) Declare that the actions of the official Respondents are by an Authority incompetent & having no jurisdiction apart from being contrary to Rule 11 of the Karnataka Civil Services (Classification, Control & Appeal) Rules, 1957 and Bruhat Bengaluru Mahanagara Palike (General Cadre and Recruitment of Officers and Employees) Rules, 2020; and c) Grant such other consequential reliefs as this Hon’ble Court may deem just and proper in the facts and circumstances of the case.” 2. Learned counsel for respondent Nos.2 and 3 submits that during pendency of the present petition, petitioner having been reinstated into service, nothing further survives in the present petition. 4. The said submission is placed on record. 5. In view of the aforesaid submission, petition stands disposed of. Liberty is reserved in favour of the respondents to proceed with the enquiry, if any, initiated by them against the petitioner. However, it is made clear that the respondents shall not be entitled to pass an order of suspension once again on the same cause of action against the petitioner. 6. In addition thereto, respondents are directed to pay / clear all arrears of subsistence allowance payable to the petitioner, if any, pending as on today and salary, if any, payable to the petitioner, immediately upon receipt of a copy of this order.
