Learned counsel for the applicant submits that this Court vide order dated 29.09.2022 passed in MCRC No. 8462 of 2022 granted bail to the applicant pursuant to which he was released from jail and has been regularly appearing before the learned Trial Court in Special Criminal Case No. H-35/2022. It is further submitted that on 11.04.2023 the applicant could not appear before the learned Trial Court as he had gone out for earning his livelihood being the sole breadwinner of his family. Due to this circumstance, he could not intimate his counsel, and consequently, a warrant of arrest was issued against him. Ultimately, the applicant was arrested on 03.12.2025. Learned counsel further submits that thereafter the applicant preferred an application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita before the learned Trial Court which came to be dismissed vide order dated 09.01.2026. It is prayed that one more opportunity may be granted to the applicant and he undertakes to appear on all dates of hearing as may be fixed by the learned Trial Court. 3. Learned counsel for the State opposes the submissions made on behalf of the applicant and contends that the applicant violated the conditions imposed by this Court while granting bail vide order dated 29.09.2022. It is, therefore, submitted that no leniency deserves to be shown to the applicant. 4. I have heard learned counsel for the parties and perused the case diary. 5. Be that as it may, taking into consideration and submission made here-in-above that earlier the applicant was granted bail by this Court on 29.09.2022 passed in MCRC No. 8462 of 2022 and also considering the facts and circumstances of the case, I am inclined to enlarge the applicant on bail. 6. Accordingly, the bail application is allowed and it is directed that the applicant shall be released on bail on his furnishing a personal bond in the 3 sum of Rs. 25,000/- with one solvent surety for the like amount to the satisfaction of the concerned trial Court on the condition that :- (i) that the applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer; (ii) that the applicant shall not act in any manner which will be prejudicial to fair and expeditious trial; (iii) that the applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial; (iv) that applicant will not involve himself in any offence of similar nature. (V) that the applicant shall not leave the State of Chhattisgarh without the leave of the trial Court. 7. It is made clear that the observations made here-in-above are only for the purpose of deciding the bail application and the trial court will decide the case on its own merit without being influenced by any observation made here-in-above. If any one of the above conditions is violated by applicant, the State will be at liberty to file application for cancellation of the bail granted to him Sd/- (Sachin Singh Rajput) JUDGE Pawan
