( At present he is confined in Sub Jail, Hinduan) ----Petitioner Versus The State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Asad UL Haq Nooree For Respondent(s) : Mr. Naresh Gupta, PP HON'BLE MR. JUSTICE BIPIN GUPTA Order 13/07/2026 1. The present bail application has been filed under Section 483 BNSS, 2023 against the order dated 20.06.2026 passed by learned Additional Session Judge, No.2, Hindaun City, District- Karoli, in Bail Application No.438/2026, whereby the bail application of the petitioner was rejected in connection with F.I.R. No.175/2025, Police Station-Hindaun City, District-Karoli, for the offences under Sections 112(2) BNS and Section 13 of Rajasthan Public Gambling Ordinance Act, 1949. 2. Learned counsel for the petitioner submits that only one criminal case has been registered against the petitioner. He further submits that the petitioner has been implicated in the present FIR solely on the basis of the disclosure made by one Krishan Kant, who was apprehended while allegedly indulging in gambling. 3. Learned counsel for the petitioner further submits that most of the co-accused, who were named by Krishan Kant and have [2026:RJ-JP:26217] (2 of 3) [CRLMB-10443/2026] also been arrayed as accused in the present FIR, have already been granted the benefit of anticipatory bail. 4. Learned counsel for the petitioner further submits that the co-accused persons, namely, Vishnu Kumar S/o Jagdish, has already been enlarged on regular bail, whereas Shankar Lal S/o Babulal and Rajendra @ Raju @ Ronak S/o Vishnu have been granted the benefit of anticipatory bail by the Coordinate Bench of this Court vide orders dated 19.05.2026 and 22.06.2026, respectively. It is submitted that the case of the present petitioner stands on no lesser footing than that of the aforesaid co-accused and, therefore, he also deserves to be enlarged on bail. 5. Learned counsel for the petitioner submits that the maximum punishment is seven (7) years. It is contended that the conclusion of the investigation/trial is likely to take considerable time. It is further submitted that the other persons, whose names surfaced on the basis of the disclosure made by Krishan Kant, have already been granted bail by the Coordinate Bench of this Court and the case of the present petitioner is on parity with that of the said co- accused. Therefore, it is prayed that the petitioner, who has been in judicial custody since 14.06.2026, may be enlarged on regular bail. 6. Learned Public Prosecutor vehemently opposes the present bail application. 7. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the material available on record. 8. Without expressing any opinion on the merits of the case and considering the submissions advanced by learned counsel for the parties; conclusion of trial will take sufficiently long time and [2026:RJ-JP:26217] (3 of 3) [CRLMB-10443/2026] further the fact that the other co-accused persons, namely, Vishnu Kumar S/o Jagdish, Shankar Lal S/o Babulal and Rajendra @ Raju @ Ronak S/o Vishnu, have already been enlarged on bail vide order dated 19.05.2026 and 22.06.2026 respectively, passed by the Co-ordinate Bench of this Court; therefore, this Court deems it appropriate that the accused-petitioners may be enlarged on bail. 9.
