It is the grievance of the petitioner that he is entitled for one increment in terms of the judgment of the Hon’ble Supreme Court in the case of Civil Appeal No. 2471 of 2023 titled “The Director (Admn. and HR) KPTCL & Ors. vs. C.P. Mundinamani & Ors.” as the petitioner retired on the last date of June. 3. The issue has already been set at rest by the Hon’ble Supreme Court in the case of Civil Appeal No. 2471 of 2023 titled
“The Director (Admn. and HR) KPTCL & Ors. vs. C.P. Mundinamani & Ors.” wherein it has been held that a person retiring on 30th June and on 31st December will get the increment which he is entitled to. 2026:JHHC:52 2

Thus, I dispose of this writ petition with the direction to the petitioner to approach respondent No. 4-The Deputy Commissioner cum Chairman, District Education Establishment Committee within four weeks along with the copy of the judgment of the Hon’ble Supreme Court. Once the representation is filed, within six weeks the same will be considered and an appropriate order will be passed considering the judgment of the Hon’ble Supreme Court. 5.
If the petitioner is entitled for any monetary benefit in terms of the judgment of the Hon’ble Supreme Court, the same should be disbursed to the petitioner within four weeks thereafter. Pensionery benefits should also be revised accordingly. 6. With the aforesaid observation and direction, this writ petition is disposed of. (ANANDA SEN, J.) 05.01.2026 Tanuj/CP-2
